ELAV8 Voice Privacy Policy

Effective date: October 6, 2026

Last updated: October 13, 2026

1. Who we are and what this policy covers

This Privacy Policy explains how ELAV8 AI LLC ("ELAV8", "we", "us") collects, uses, shares, and protects personal information when you use ELAV8 Voice: our apps for iPhone and Android and our web app at voice.elav8.ai (together, "ELAV8 Voice"). It does not cover our marketing website or our other products, which have their own policies. The list is on the policies page.

ELAV8 Voice is offered in the United States and Canada. Questions: privacy@elav8.ai.

2. The short version

  • ELAV8 Voice is a voice assistant. To work, it collects what you say and share, your plans, and, with your permission, your calendars and location.
  • We use AI providers (Google Gemini, Anthropic, OpenAI, and xAI) to understand and answer you. The iPhone and Android apps ask your permission before anything is sent. The web app relies on this policy.
  • We do not sell your information, show ads, or track you across other companies' apps and websites.
  • We do not use your conversations or content to train AI models.
  • You can delete your data or your whole account in the app at any time. Deleting your account is immediate and permanent.
  • ELAV8 Voice is for adults 18 and older.

3. Information we collect

Account and profile

Your name, email address, and password (stored by Amazon Cognito in a form we cannot read) and, if you add them, your phone number, birth date, and profile photo. If you sign in with Apple or Google, we receive your name, your email address (or Apple's private relay address), and an account ID. We also record when you confirmed you are 18 or older and which version of our AI consent you accepted.

Conversations

When you talk to ELAV8, your voice is sent to the AI provider for that request so it can understand you. Today that provider is Google Gemini. We do not store recordings of your voice. We store the text of the conversation and ELAV8's answers in your account, unless you turn off Store live sessions.

Things you share

Photos, files, and camera or screen views you share with ELAV8, files you attach to tasks, and screenshots you attach to feedback. Camera and screen views go to the AI provider for that request while you share them and are not stored. Photos and files you share in a conversation are saved with it. When a conversation is erased, the photos saved with it are erased too.

Your plans

Tasks, goals, ELAV8 Balance targets, notes, reminders, your preferences (including how ELAV8 talks to you), and your answers during setup.

Calendars and reminders, if you connect them

Your Google Calendar events and Google Tasks and, on iPhone, your Apple Calendar events and Reminders. Events can include other people's names and email addresses, such as attendees and organizers.

Location, only with your permission

Your device's precise location while you use the app, for travel times, traffic alerts, and local weather. A home address if you add one for traffic alerts. The city and region you are in. We also estimate your general location from your IP address to protect your account.

ELAV8 Aliens

Missions you approve, what you share for them, the questions and answers along the way, the sources and write-ups produced, and the facts and preferences ELAV8 Aliens remembers to help you next time.

Feedback and reports

Messages you send us, screenshots you attach, and reports about AI answers or images (your reason, your note, and the reported text).

Device and usage information

Device model, operating system, app version, language, time zone, IP address, an identifier for our app on your device, push notification tokens, how you use features, crash and performance data, and security signals about whether the app or device has been tampered with.

On the web app, cookies and similar storage, described in Cookies on the web app. We do not read your contacts, and we only use the photos you choose to share.

4. How ELAV8 uses AI

Each request goes to one AI provider: Google (Gemini), Anthropic (Claude), OpenAI (GPT), or xAI (Grok). Today that provider is Google Gemini, through Google's paid Gemini API and Google Cloud's Vertex AI. Agreeing once covers a request sent to any of them.

The iPhone and Android apps need this permission to work. You tick "I agree to share this with ELAV8's AI providers." There is no way to skip that and keep using the app. From that screen you can still sign out or delete your account. An account that already exists is asked the next time it opens the app. The web app at voice.elav8.ai does not show that screen. By continuing there, you agree to the Terms of Use and this Privacy Policy, including how ELAV8's AI providers process your requests.

What a request can send, and when

  • When you talk to ELAV8: your voice, streamed live while the microphone is on, and the text of the conversation. Today this goes to Google Gemini. Your device connects directly to Google for live voice, so Google also receives your device's IP address.
  • When you share your camera, your screen, a photo, or a file: what you share.
  • To answer or act on a request: the parts of your ELAV8 information the request needs, such as tasks, goals, calendar events (including other attendees' names and email addresses), reminders, your first name, your preferences, and your city, region, or local weather.
  • For ELAV8 Aliens: the mission you approved, what you share for it, and the questions and answers along the way.
  • When you ask ELAV8 to look something up: your request. Google answers it using Google Search.

What the AI providers do with it

The provider processes it to produce ELAV8's answers. We only use providers that do not train their models on your data. Google keeps what the Gemini API receives only for a limited time to detect abuse (up to 55 days) and then deletes it. This policy does not state a retention period for Anthropic, OpenAI, or xAI.

What we keep

We do not store recordings of your voice. We keep the text of your conversations and ELAV8's answers in your account, as described in How long we keep information.

What we do not do

We do not use your conversations or content to train AI models, ours or anyone else's. We do not create voiceprints or use your voice to identify you. We do not use AI to make decisions about you that have legal or similarly significant effects.

Your choice

On iPhone and Android you can turn this off in Settings, then Data & Privacy, then Share with AI providers. The app stops until you turn it back on. The web app has no such switch. To erase what you have already shared, use Delete all data or delete your account.

5. How we use information

We use personal information to:

  • provide ELAV8 Voice: answer you, keep your history, sync your calendars and tasks, send the reminders and notifications you ask for, and run ELAV8 Aliens missions;
  • personalize it, such as using your preferences, location, and schedule to make answers relevant;
  • keep it safe: secure accounts, prevent fraud and abuse, enforce our Terms, and check that the app has not been tampered with;
  • support you and respond to feedback and reports;
  • understand and improve ELAV8 Voice with usage analytics and crash reports (you can turn analytics off);
  • send service messages, such as sign-up codes, password resets, and notices about changes to these documents, and, if you allow it, notifications about new features;
  • comply with the law.

We do not use your information for advertising, we do not sell it, and we do not use your conversations or content to train AI models. If we want to use your information in a new way, we will ask you first.

6. Google user data

If you connect your Google account, ELAV8 asks Google for access to your Google Calendar and Google Tasks so it can show, create, and update your events and tasks. We use this data only to provide those features to you. When you ask ELAV8 about your schedule or tasks, the events or tasks involved are sent to ELAV8's AI providers to answer you (see How ELAV8 uses AI).

We do not sell Google user data, use it for advertising, or use it to train AI models. People at ELAV8 do not read it unless you ask us to (for example, to help with a support request), it is needed for security, or the law requires it.

ELAV8's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

You can remove ELAV8's access in Settings, then Integrations, or in your Google Account's security settings. Removing the Google account stops syncing and deletes our access to it right away. Events and tasks already copied to ELAV8 stay in your account until you delete them, use Delete all data, or delete your account.

Privacy requests: privacy@elav8.ai.

7. Apple data

Sign in with Apple. We receive your name, your email address (or a private relay address if you choose Hide My Email), and an Apple account ID. When you delete your ELAV8 account, we ask Apple to remove ELAV8's access.

Apple Calendar and Reminders (iPhone). If you allow access, ELAV8 reads and updates the calendars and reminders on your iPhone to show them in ELAV8 and make the changes you ask for. They stay on your iPhone unless you ask the assistant about them (then the items it reads go to the AI provider for that request and the conversation is saved to your account) or you turn on Sync to ELAV8, which keeps a copy in your account so the same items appear on the web and your other devices. Stop mirroring and delete removes that copy.

Age check. Where the law requires us to check age, we ask Apple for your age range. Apple tells us only whether you are 18 or older, never your birthday.

Fast Commands. Voice shortcuts use your device's own speech recognition, which Apple (or Google, on Android) may process on its servers under its own privacy policy.

Notifications and place names. Notifications reach your device through Apple's push service (Google's on Android). On iPhone, turning a place name into map coordinates uses Apple's location services.

8. Who we share information with

We share personal information only:

  • with the service providers listed below, which process it for us to run ELAV8 Voice;
  • with the AI provider for that request (Google Gemini, Anthropic, OpenAI, or xAI), as described in How ELAV8 uses AI;
  • with services you connect, such as Google Calendar, when you ask ELAV8 to act on them;
  • when the law requires it, or to protect the rights, property, or safety of our users, the public, or ELAV8;
  • as part of a merger, acquisition, or sale of assets, in which case we will tell you before your information becomes subject to a different privacy policy;
  • with your consent.

We require every service provider to protect your information at least as well as this policy does and to use it only to provide its service to us.

We do not sell your personal information, and we do not share it for targeted (cross-context behavioral) advertising. We have not done either in the past 12 months. ELAV8 Voice has no ads and does not track you across other companies' apps or websites.

9. How long we keep information

  • Your account and profile: until you delete your account.
  • Conversations and what you shared in them: until you delete them. You can have ELAV8 delete conversations automatically after 7, 30, 90, 180, or 365 days (or 24 hours on the web), or turn off Store live sessions so they are never saved.
  • Tasks, goals, notes, ELAV8 Balance, and preferences: until you delete them.
  • A deleted conversation, task, goal, event or feedback thread disappears at once, and its content is erased about 30 days later, together with the conversation's photos. Files attached to a deleted task or feedback message, and images ELAV8 created, stay until you use Delete all data or delete your account. Tasks and events linked to Google keep a record without content (IDs and dates), so sync doesn't copy them back.
  • Calendar events and tasks copied from Google: while your Google account is connected, and afterwards until you delete them, use Delete all data, or delete your account.
  • Apple Calendar and Reminders copies (only if you turn on Sync to ELAV8): until you choose Stop mirroring and delete, use Delete all data, or delete your account.
  • Location for traffic alerts: only your latest location, erased after 1 hour. A home address you add: until you change or remove it. Address lookup cache: 30 days.
  • Notifications in the app: 30 days.
  • Push notification tokens: kept until you sign out, use Delete all data or delete your account. A token from an uninstalled app is deleted 30 days after it stops working.
  • Feedback, messages, and reports: until you use Delete all data or delete your account.
  • ELAV8 Aliens missions and results: until you use Delete all data or delete your account. A protected audit archive keeps ELAV8 Aliens results for up to 12 months, even after deletion. Files you attach: 30 days after upload. Facts ELAV8 Aliens remembers: 180 days after last use. Preferences and instructions: 400 days after last use.
  • ELAV8 Aliens run history: 30 days.
  • Monitoring keeps ELAV8 Aliens research prompts and answers for 15 days.
  • Usage analytics: until you delete your account, which erases them. Turning off Share usage analytics stops new collection.
  • Crash reports: 90 days. Performance data: up to 13 months.
  • Server logs: up to 365 days (15 days in monitoring).
  • Deleted information can stay in our encrypted database backups for about 12 months (at most 12 months and one week). We use backups only to recover from outages.
  • Google keeps what ELAV8 sends to Gemini for up to 55 days, only to detect abuse.
  • Posts stay in our team chat. Nothing deletes them automatically today. Email privacy@elav8.ai to have yours removed.

After you delete your account, these copies can still outlive that deletion: encrypted database backups, the ELAV8 Aliens audit archive, monitoring and logs, and team chat posts. We also keep records without your content that we need for billing and abuse limits (such as how much of ELAV8 Aliens you used), and anything the law requires us to keep.

10. Your choices, and deleting your data

  • Delete your account. On iPhone, tap your profile picture, then Personal info, then Delete account. On the web, go to Settings, then Personal info, or Settings, then Data & Privacy. Deleting your account is immediate and permanent. It erases your account and the content in it, including usage analytics, removes ELAV8 from your Apple and Google account permissions, and signs you out everywhere. It cannot be undone.
  • Delete all data. Settings, then Data usage preferences, then Delete all data. On the web: Settings, then Data & Privacy, then Your stored data. It erases your content and settings and keeps your account.
  • Share with AI providers. On iPhone and Android: Settings, then Data & Privacy, then Share with AI providers. Turning it off stops the app until you turn it back on. The web app has no such switch.
  • Usage analytics. Settings, then Data usage preferences, then Share usage analytics. On the web: Settings, then Data & Privacy.
  • Conversations. Settings, then Data usage preferences, then Auto-delete live sessions, and Store live sessions.
  • Connected accounts. Settings, then Integrations, to remove Google or Apple.
  • Notifications. Settings, then Notification preferences, or your device settings.
  • Location, microphone, camera, calendars, reminders, and speech recognition. Your device settings. ELAV8 asks before using any of them, and keeps working without them, with fewer features.

If you cannot use the app, email privacy@elav8.ai from the address on your account, and we will handle your request by email.

11. Your privacy rights

Depending on where you live in the United States, you may have the right to:

  • know what personal information we have about you and get a copy, including in a portable format;
  • correct inaccurate information;
  • delete your information;
  • opt out of the sale of personal information, targeted advertising, and profiling with legal or similarly significant effects (we do not do any of these);
  • limit the use of sensitive personal information (we use precise location and similar information only to provide what you ask for, and only after you allow it);
  • withdraw your consent, such as to sharing with ELAV8's AI providers or to collecting location. On iPhone and Android, turning off Share with AI providers stops the app until you turn it back on;
  • appeal our decision on your request.

You can do most of this yourself in the app (see Your choices). Otherwise, email privacy@elav8.ai. We will confirm it is you, usually by checking the request comes from your account's email address, and answer within 45 days. If we need more time, we will tell you why. You can use an authorized agent, and we will ask for proof that they can act for you.

To appeal, reply to our answer with "Appeal" within 60 days, and we will respond within 60 days. If you are not satisfied, you can contact your state attorney general. We will not treat you differently for using these rights.

If you live in Canada, including Quebec, you can ask us to access, correct, or delete your personal information, and to withdraw consent, under the Personal Information Protection and Electronic Documents Act (PIPEDA) and, in Quebec, under Law 25. Email privacy@elav8.ai. We store and process ELAV8 Voice information in the United States, outside Canada.

12. Adults only (18+)

ELAV8 Voice is only for people 18 and older. We ask everyone to confirm they are 18 or older and, where the law requires it, we check age with Apple. We do not knowingly collect information from anyone under 18. If we learn we have, we delete the account and its information. If you believe someone under 18 is using ELAV8, email privacy@elav8.ai.

13. Security

We protect your information with encryption in transit and at rest, access controls that limit who at ELAV8 can see it, monitoring of our systems, and security checks inside the app. No system is perfectly secure. If a breach affects your personal information, we will notify you and the authorities as the law requires.

14. Where we process information

We are based in the United States. We store and process ELAV8 Voice information in the United States, outside Canada, mainly with Amazon Web Services in Ohio and Google Cloud in Virginia. A few providers handle limited information elsewhere. MET Norway, in Norway, receives a location rounded to about 1 km to provide weather.

15. Do Not Track and Global Privacy Control

ELAV8 Voice does not sell your information, use it for targeted advertising, or track you across other companies' websites or apps, and no other company collects information about your activity across websites through ELAV8 Voice. So there is nothing for a Do Not Track or Global Privacy Control signal to turn off. If that ever changes, we will honor those signals.

16. Cookies on the web app

The web app at voice.elav8.ai uses a few cookies and similar browser storage. Essential ones keep you signed in securely (an encrypted session cookie that lasts about 30 days), protect against forged requests, complete sign-in with Apple or Google (10 minutes), and remember that you confirmed your age (30 days). Others remember display choices, such as theme and voice. PostHog's analytics storage measures how the web app is used, and PostHog stops collecting when you turn off Share usage analytics. We do not use advertising or cross-site tracking cookies. If you block essential cookies, sign-in will not work.

This is not the cookie policy for elav8.ai. That site has its own Cookie Policy.

17. Changes to this policy

We will post any update here with a new Last updated date. If a change is significant, we will tell you in the app or by email before it takes effect and, where the law requires it, ask for your consent first, for example before sending new kinds of information to an AI provider.
