1. Information We Collect

1.1 Information You Provide to Us

We collect personal information that you voluntarily provide on this website. This includes:

• Form information: When you submit a form on this website, we collect what you enter, such as your name, email address, and, if you opt in, your phone number. Product accounts, including sign-in with Apple or Google inside ELAV8 Voice, are described in that product's privacy policy.
• What you send us: We collect the messages, files, and answers you submit on this website, including support notes and form fields. Voice conversations, calendars, and tasks inside ELAV8 Voice are covered by the ELAV8 Voice Privacy Policy, not this page.
• Sensitive Data: We do not intentionally collect sensitive categories of personal information such as health data, biometric identifiers, financial account details, Social Security numbers, or government-issued IDs. Please do not submit this type of information to our Services. If you do, it will be processed only as necessary to fulfill your request, and we disclaim liability for handling of such sensitive data outside the intended scope of our Services.
• Product connections: This website does not connect your Google Calendar, Gmail, or Slack. If a product does, that product's privacy policy describes it. ELAV8 Voice, for example, describes Google Calendar and Google Gemini in its own policy.
• Communications: If you contact us directly (for support, feedback, or other inquiries), we will receive the content of your communications and any contact information you provide (like your email or phone number). We will use this information to respond to you and resolve any issues.
• Contact-Preference and Consent Records: When you submit one of our request-access forms, we record whether you opted in to SMS messaging, AI-generated phone calls, and marketing email. For each opt-in, we also keep a timestamp, the form that was submitted, your IP address at submission, your user agent, and the exact version identifier of the disclosure language you saw. We use this record to honor (and prove) your consent choices and to comply with U.S. communications laws. See Section 5 for the full Communications policy.
• Payment information: This website does not collect payment card numbers. If a product charges for a plan, that product's privacy policy and terms describe billing. FALA billing is described on fala.elav8.ai.

1.2 Information We Collect Automatically

When you use our Services, we automatically collect certain information about your device and usage of the Services:

• Device and Technical Data: We collect data about the browser and device you use to open this website. This includes browser type, operating system, IP address, and general device type. Product apps describe their own device data in their privacy policies.
• Usage and Log Data: We gather information about how you interact with our Services. This includes timestamps of access, pages or screens viewed, features used, links clicked, and actions taken (for example, which pages you open). We also log diagnostic details like crashes, errors, and load times to help us fix issues and improve performance.
• Cookies and Tracking Technologies: Like many online services, we use cookies and similar tracking technologies to provide and measure this website. Cookies are small text files stored on your browser. They help us remember your cookie choices and understand how visitors move through the site. We may use both first-party and third-party cookies (for analytics and functionality). You can control or delete cookies through your browser settings, but note that some parts of our Service may not function properly without them. • Location Information: We do not collect precise GPS location on this website. We may infer a general location, such as a city or region, from your IP address. We use that for security and to understand where site traffic comes from. Product apps describe any device location they collect in their own privacy policies.
• Device permissions: This website does not ask for your microphone, camera, contacts, or calendar. If a product app does, that product's privacy policy describes it.

1.3 Information from Third Parties

Apart from the third-party integrations you connect (discussed above), we may also receive information from other sources:

• Social Login Providers: This website does not offer Google, Apple, or Facebook sign-in. If a product app does, that product's privacy policy describes what the sign-in provider sends.
• Service Providers and Partners: We receive site analytics from the vendors named in Section 3, such as aggregated reports of page visits. App store download or purchase records belong to the product privacy policy, not this page.

We do not purchase personal data from data brokers or other third-party sources. Also, as of now, we do not collect information about you from social media or public databases unless you explicitly interact with us there or grant permission.

3. How We Share or Disclose Information

We may disclose personal information in the following circumstances:

• Service Providers and Vendors: We employ trusted third-party companies and individuals to perform functions and provide services to us (processors). This includes web hosting providers, cloud storage services, data analytics services, customer support tools, email/SMS delivery services, and other IT or security service providers. These service providers are given access to personal information only to the extent necessary to perform their tasks on our behalf and are obligated not to disclose or use it for other purposes. For example, our cloud hosting provider stores the data on secure servers, and our email service helps send messages you asked for. This website does not use a payment processor. We ensure that all such third parties are bound by appropriate confidentiality and data protection obligations.
• Product AI: This website does not send what you type here to OpenAI, Anthropic, or Google Gemini. ELAV8 Voice describes Google Gemini in its own privacy policy. FALA describes its AI providers in the FALA privacy policy.
• Third-Party Integrations You Enable: When you choose to leave this website for a product or a third-party site, that destination's policy applies from there. For example, connecting Google Calendar is an ELAV8 Voice feature, described in the ELAV8 Voice Privacy Policy, not on this page. We will share information from this website only as needed to deliver a form you submitted. A form provider receives the fields you sent. Information a product or another company receives after you leave this website is governed by that company's privacy policy.
• Affiliates: If ELAV8.ai is part of a family of companies in the future (for example, if we have parent companies, subsidiaries, or common ownership), we may share information within that corporate group, in which case those entities will honor this Privacy Policy. This would only be done as needed to help provide the Services or for internal administrative purposes.
• Business Transfers: If we are involved in a merger, acquisition, investment, financing, reorganization, bankruptcy, or sale of all or a portion of our business, personal information may be transferred to a successor or affiliated entity as part of that transaction. We would ensure that any such entity is bound to treat your information in accordance with this Policy, and we would provide notice of any significant change in data handling.
• Legal Compliance and Protection: We may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to: (i) comply with a legal obligation, subpoena, or government request; (ii) enforce our Terms of Service or other agreements; (iii) protect and defend our rights, property, or safety, or that of our users or others; (iv) investigate and prevent fraud or other unlawful activity or security issues; or (v) protect against legal liability. In such cases, we will only share the information that is reasonably necessary for the specific purpose and, when possible, will require the recipient to maintain confidentiality.
• With Your Consent: Apart from the cases above, if we ever need to share your personal information for any other purpose, we will ask for your consent. For example, if we want to use your testimonial or success story on our website, we would seek your permission before doing so. You are in control of whether we share your personal info in ways not covered by this Policy.

3.1 Named Sub-processors

Below is the current list of third-party processors we use. We update this list whenever we add, remove, or change a vendor. For GDPR Article 28 and CCPA/CPRA "right to know" purposes, this list is authoritative.

The Google Consent Mode v2 behavior described above applies on the ELAV8 marketing website. It does not apply on fala.elav8.ai, which is covered by FALA's own privacy policy, or on the ELAV8 Voice legal pages, which do not load these advertising tags.

Payment processors are not used on this website. Product billing, where it exists, is described in that product's privacy policy.

5. SMS, Calls, and Marketing Communications

When you submit one of our request-access forms, you may choose to opt in to one or more of the following contact programs by ticking the corresponding checkbox. The checkboxes are independent — picking one does not opt you in to any other.

• SMS (text messages): If you opt in, we may send recurring SMS messages about your alpha program participation, product announcements, and onboarding assistance from ELAV8.ai or CONVOLENS by ELAV8, depending on which form you used. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. Full SMS program details are described in our Messaging Terms.
• AI-generated and automated phone calls: If you opt in, we may place automated phone calls to the number you provided. Those calls may use an artificial or pre-recorded voice and are treated as "artificial or pre-recorded voice" communications under the U.S. Telephone Consumer Protection Act (TCPA). You may revoke this consent at any time by replying STOP to a related SMS, asking the AI assistant on the call to stop calling, or emailing privacy@elav8.ai. See our Messaging Terms Section 7 for details.
• Marketing email: If you opt in, we may send recurring marketing and product-update emails. You can unsubscribe at any time using the link in every email or by contacting us. Transactional and account-essential emails (alpha-access delivery, security notifications, support replies) may still be sent regardless of marketing opt-in status.

Record of Consent

For each opt-in we receive, we keep a record of the consent so we can verify which messages you authorized. That record includes a timestamp, the form you submitted, the IP address that submitted the form, the user agent, and the exact version identifier of the disclosure language you saw. We retain this record for as long as we may need it to demonstrate compliance, and we treat it as personal data under this Privacy Policy.

No Sharing of Phone Numbers

We do not sell or share your mobile phone number, your SMS opt-in status, or your AI-calls opt-in status with third parties for their own marketing. We share that data only with service providers (for example, our SMS provider and our AI-calling provider) to the extent necessary to deliver the messages you asked for, and those providers are bound by confidentiality and data-protection obligations.

Per-Brand Consent

Consent to receive messages from one ELAV8 brand or product line does not authorize messages from any other entity, and consent is not transferred or shared across brands. If you give consent for ELAV8 Voice messaging, that does not by itself authorize CONVOLENS messaging, and vice versa.

6. Data Retention

We retain personal data for only as long as it is necessary to provide our Services and meet the purposes described in this Policy, unless a longer retention period is required or permitted by law. In determining how long to keep data, we consider factors such as how long we need a form record, the nature and volume of data, the potential risk of harm from unauthorized use or disclosure, and any legal obligations to retain certain records.

Typically, this means:

• Form records: Information you submit on this website, including contact details and consent records, is kept for as long as we need it to respond, honor your messaging choices, and meet legal duties. You can ask us to delete it. See Your Rights below.
• Product accounts and content: Tasks, calendars, conversations, and product billing records are not stored under this policy. Each product's privacy policy describes how long it keeps that information and how to delete an account.

When we have no ongoing legitimate business need or legal requirement to keep your personal information, we will delete or anonymize it. If immediate deletion is not feasible (for example, because the data is stored in secure backups), we will securely store the data and isolate it from any further use until deletion is possible.

Backups: Please note that residual copies of your information might persist in backup media for a short period (due to our routine backup procedures), but they will be purged according to our backup retention policies. During that time, we will ensure the data remains protected and not used for any active purpose. Users may also request early deletion of their data at any time, even before the standard retention period expires, by contacting us at privacy@elav8.ai.

8. Children's Privacy

This website requires you to be 18 or older, the same rule as the website terms. We do not knowingly collect personal information from anyone under 18. If you are under 18, please do not use this website or send us personal information. If we learn that we have, we will delete it. ELAV8 Voice is only for people 18 and older. That rule is in the ELAV8 Voice Privacy Policy.

We comply with the U.S. Children's Online Privacy Protection Act (COPPA). If we discover that we have collected information from a child under 13 without verified parental consent, we will promptly delete it.

10. International Users and Data Transfers

While ELAV8.ai is currently focused on users in the United States, our Service may be accessed from outside the U.S. If you use the Services from another country, be aware that your information will be transferred to and processed in the United States (or other jurisdictions where we or our service providers operate). The data protection laws in these jurisdictions may differ from those in your home country.

We will take steps to ensure that appropriate safeguards are in place to protect your data in transit and at the destination. For example, we may rely on standard contractual clauses or other lawful transfer mechanisms for any transfer of personal data from the European Economic Area (EEA), United Kingdom, or other regions with data transfer restrictions. By using our Services, you consent to your information being transferred to our facilities and those third parties with whom we share it as described in this Policy.

If you are an international user, you may have additional rights under your local laws (for example, the GDPR in Europe grants rights to access, delete, object, restrict processing, and more – see Your Privacy Rights above). We aim to provide a privacy-respecting service globally, and we will comply with applicable legal requirements.
