Messaging Terms

These Messaging Terms describe the SMS, AI-generated phone calls, and marketing-email programs operated by ELAV8™.ai (including the CONVOLENS by ELAV8 product line). They explain what messages you can expect to receive if you opt in, how to opt out, how to get help, and how we protect your phone number and consent. They apply alongside our Privacy Policy and Terms of Service. By opting in to any of the channels below, you agree to these terms for that specific channel.
1. Programs and Message Types
ELAV8 operates the following voluntary contact programs. Each is an independent opt-in — choosing one does not opt you in to any other.
- ELAV8 Alpha SMS: Recurring SMS messages about the ELAV8.ai alpha program, product announcements, and onboarding assistance.
- CONVOLENS Alpha SMS: Recurring SMS messages about the CONVOLENS by ELAV8 alpha program, product announcements, and onboarding assistance.
- AI-Generated Phone Calls: Automated and AI-generated phone calls about your alpha program participation. Calls may use an artificial or pre-recorded voice. See Section 7 for details.
- Marketing Email: Recurring marketing and product-update emails. You can unsubscribe at any time using the link in every email.
Transactional and account-essential messages (for example, alpha-access delivery, password resets, security notifications, or replies to your support questions) may be sent regardless of opt-in status. Those are not marketing.
2. How to Opt In
You can join any combination of the programs above by ticking the corresponding checkbox on one of our request-access forms:
- The ELAV8 Voice alpha-access form (modal on the ELAV8.ai homepage).
- The CONVOLENS alpha-access form (modal on the CONVOLENS page).
- A future opt-in form operated by ELAV8 that displays these terms inline.
Consent is not a condition of purchase or of getting alpha access. You can request access without opting in to any contact program.
By submitting one of these forms with an opt-in box checked, you confirm that you are the subscriber or account-holder of the phone number you provided and that you are authorized to consent on its behalf.
3. How to Opt Out
You can revoke consent for any channel at any time:
- SMS: Reply STOP (or END, CANCEL, UNSUBSCRIBE, QUIT) to any message we send. You will receive a single confirmation message and no further marketing SMS.
- AI-generated calls: Tell the assistant on the call that you wish to stop receiving calls, reply STOP to any related SMS we send, or email contact@elav8.ai asking us to remove your number.
- Marketing email: Click Unsubscribe in any marketing email we send, or email contact@elav8.ai.
Revoking consent for one channel does not affect the others. After you opt out, we will stop the relevant marketing messages within a reasonable processing window; service-essential messages may still be sent.
4. How to Get Help
Reply HELP to any SMS we send, or contact us at contact@elav8.ai for help with any of our messaging programs.
5. Frequency and Rates
Message frequency varies based on your activity in the alpha program and on what we have to share. You should expect a small number of messages per month during typical periods, with occasional bursts around launches or major product updates.
Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Standard wireless carrier charges from your mobile service provider apply to any SMS you send or receive.
6. Supported Carriers and Numbers
Our SMS and AI-calling programs accept U.S. mobile numbers only. We do not currently support international numbers or U.S. landline numbers for AI calls.
Major U.S. carriers (including AT&T, T-Mobile, Verizon, US Cellular, Boost, Cricket, Metro by T-Mobile, and most MVNOs) are supported. Carriers are not liable for delayed or undelivered messages, and message delivery is not guaranteed on every network.
7. AI-Generated and Automated Calls
In Short: If you opt in to AI-powered phone calls, ELAV8 may place automated calls to the number you provided. Those calls may use an artificial or pre-recorded voice. You can revoke consent at any time.
AI-generated voice calls are treated as "artificial or pre-recorded voice" communications under the U.S. Telephone Consumer Protection Act (TCPA) and applicable Federal Communications Commission (FCC) rules. ELAV8 only places such calls after you have ticked the dedicated AI-calls opt-in on one of our forms (see Section 2). Consent is per-brand: opt-in for ELAV8 does not authorize calls from any other entity, and consent is not shared or sold to third parties.
Every AI call will identify ELAV8 as the caller at the start of the call and give you a way to end the call or request that we stop calling. You can also email contact@elav8.ai at any time to revoke consent.
Consent to receive AI-generated calls is not a condition of purchase or alpha access.
8. Privacy and Non-Sharing
In Short: We do not share your phone number, SMS opt-in status, or call-consent status with third parties for their own marketing.
ELAV8 does not sell or share your mobile phone number or your SMS / AI-calls / email opt-in status with third parties for their own marketing purposes. We share that data only with service providers who help us deliver the messages you asked for (for example, our SMS provider and our AI-calling provider), and only to the extent necessary to deliver them. Those providers are bound by confidentiality and data-protection obligations.
We keep a record of each consent you give — including a timestamp, the form you submitted, the exact disclosure language you saw, and the IP address that submitted the form — so we can prove which consent supports which message. See our Privacy Policy for full data-handling details.
9. Changes to These Terms
We may update these Messaging Terms from time to time to reflect changes in our practices or in applicable law. When we make changes, we post the updated Messaging Terms with a new Last Updated date and bump the disclosure version shown at the top of the page. Material changes will be communicated through one of the channels you have opted in to where reasonable.
Your continued participation in any of the programs after a change takes effect constitutes acceptance of the updated terms for that program. If you do not agree, you may revoke consent at any time using the instructions in Section 3.
